Dear User, we invite you to pay attention to the following Notice ("the Notice"), issued pursuant to article 13 of Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data, and on the free movement of such data ("GDPR").
This document contains a description of all the processing carried out by the Data Controller, as defined below.
Please note that the Notice only concerns the APP Vespa; therefore any web page to which you may be redirected from the APP Vespa is deemed to be excluded.
In addition, if you purchase products or use Piaggio services through official Piaggio channels rather than through the APP, at the time of such purchase or use you will be issued with a specific Notice pursuant to art. 13 of the GDPR relating to your personal data processed at that moment.

 

1. The Data Controller

 

The Data Controller is Piaggio & C. S.p.A., whose registered office is at Viale Rinaldo Piaggio 25, Pontedera (PI) ("the Data Controller").

 

The Data Controller has also appointed a Data Protection Officer ("DPO"), whom you may contact directly to exercise your rights and to receive any information concerning the processing of your personal data and/or concerning this Notice, by writing to:

2. The personal data we process

 

2.1 Data provided voluntarily by the user

 

The Data Controller processes the following personal data:
personal details: such as first name, surname, date of birth, driving license number, profile photo, address, telephone number, Country, e-mail address and other contact details;
usage data - the data collected automatically by the Application including: the identification of the device where the app is installed that connects to VESPA, the time of the request to the servers, the method used to submit the request the server, the file size obtained in response, the numerical code indicating the status of response from the server (successful, error, etc.) the country of origin, a series of technical data related to the use of VESPA associated to the App including:

 

  • Vehicle name
  • Model
  • Displacement
  • Production year
  • VIN
  • Total km
  • Last service check
  • Vehicle picture
  • Average speed of the vehicle during the trip
  • Average consumption of the vehicle during the trip
  • Distance traveled during the trip
  • Start date and duration of the trip

 

Usage of your location

 

You can authorize the app to record your location as long as you are actively using the app or it is open in the background. To use the app, you do not have to agree to record your location but certain features of the app depend on the location information about your mobile device and your vehicle being recorded. If you authorize the app to use your location, navigation via the app is possible (turn-by-turn, POI search and position display on the navigation maps). If you allow us to record your location, your journeys will also be recorded in the "activities" section. All data on the route can be viewed and deleted by the user in the app at any time. Deleting the vehicle profile also removes all associated activities. Please note, in this context, that the continued activation of GPS running in the background can significantly reduce the battery life of your mobile device. If you have agreed to the recording of your location information, the app will store your location data locally on your device, without further access by the Data Controller or any third party, indefinitely. If you decide not to release the information on your location for the app or the “activities” function is not switched on, the app will no longer record it.
To take advantage of some features of the App data on your geographical location are required and in some cases your movements are tracked by the GPS system of your device Apple or Android. In particular, through the device on which the App is installed, you can activate or deactivate at any time and at your discretion any the functionality related to the geo-location, the recording of your routes, possibility to share of routes with other users of the App, the service for locating VESPA workshops, recording driving parameters, receiving notices on maintenance and the state of the bike. The data related to your geographical position and your travels are processed by PIAGGIO only to activate the functionality of the App when you request such features. The data is recorded both on your device and on PIAGGIO’s servers, so that you can access and use them through the VESPA app platform in case of subsequent replacement or loss of your device. You can at any time delete the data recorded through the App itself or deleting your complete account. After 12 months from the last access to the App or after 60 days from the date of deactivation / uninstallation of the App, the related data recorded by the App on PIAGGIO's servers will be deleted. The other personal data related to your interaction with PIAGGIO, also through the App, will be kept by PIAGGIO within the limits permitted by law and in compliance with PIAGGIO’s Data Retention Policy. 3. The purposes for which your personal data is processed and the legal basis of processing

 

The personal data you provide processed by the Data Controller for the following purposes.

 

3.1 Provision of services

 

The Data Controller wishes to process your personal data in order to give you access to the services offered by the App.
Nature of the data processing consent: Optional.
Consequences of refusal to allow data processing: Failure to give consent will make it impossible for the Data Controller to meet your requests as described in the first paragraph above.
Legal basis of the processing: Article 6 (1) (b) of the GDPR. It is therefore not necessary to obtain your prior consent to allow processing.
Personal data retention period: Your personal data obtained for these purposes will be processed for the time strictly necessary to comply with your request and will be subsequently retained for the time required by the applicable regulations after such compliance and, in any case, for a maximum period of ten years.

 

3.2 Marketing activities on products and services similar to those already requested by the User

 

The Data Controller wishes to process your personal data in order to send you commercial communications relating to products and services similar to those requested by you and offered by the Data Controller and through the Data Processors duly appointed pursuant to art. 28 of the GDPR.
Purposes of the processing: Sending advertising material, promotion and sale of products, market surveys and research and/or commercial communications.
Nature of the data processing consent: Optional.
Consequences of refusal to allow data processing: Failure to give consent will make it impossible for the Data Controller to send you promotional and marketing communications.
Legal basis of the processing: Legitimate interest.
Personal data retention period: Your personal data obtained for this purpose will be processed until you decide to object to the processing and/or to obtain termination of the processing at any time and, in any case, for a maximum period often years.

 

3.3 Marketing activities

 

The Data Controller wishes to process your personal data in order to send you commercial communications relating to all products and services offered by the Data Controller and through the Data Processors duly appointed pursuant to art. 28 of the GDPR.
Purposes of the processing: Sending advertising material, promotion and sale of products, market surveys and research and/or commercial communications.
Nature of the data processing consent: Optional.
Consequences of refusal to allow data processing: Failure to give consent will make it impossible for the Data Controller to send you promotional and marketing communications.
Legal basis of the processing: Consent
Personal data retention period: Your personal data obtained for this purpose will be processed until you decide to object to the processing and/or to obtain termination of the processing at any time and, in any case, for a maximum period often years.

 

4. The methods used to process your personal data

 

Your personal data will be processed in compliance with the provisions of the GDPR using paper, computer and telematic means, using methods strictly related to the specified purposes and in all cases guaranteeing security and confidentiality in accordance with the provisions of article 32 of the GDPR.

 

5. Persons to whom your personal data may be communicated or who may become aware of it

 

To fulfil the purposes described in point 3 above, your personal data will be known by the Data Controller's dependent and quasi-dependent personnel and by its contractors, all acting in the capacity of persons authorised to process personal data.
In addition, your personal data will be communicated and processed by third parties belonging to the following categories:

 

  1. Persons used by the Data Controller to manage the App
  2. Companies that manage the Data Controller's computer system
  3. Companies and consultants providing legal and/or financial advice
  4. Authorities and supervisory and control bodies, and in general public or private entities with functions relating to public law
  5. Persons used by the Data Controller for various reasons to provide the requested service
  6. Other Piaggio Group companies, for the purposes of marketing, direct sales, market surveys and for statistical processing such as monitoring the degree of customer satisfaction in relation to the services and products offered by Piaggio and/or other Piaggio Group companies, as well as for communication to third parties (e.g. suppliers) if this is necessary to enable you to benefit from our services.

 

You have the right to revoke the consent you may have provided at any time. This will make it impossible for the Data Controller to continue to use your personal data for the purpose in respect of which you have refused consent.
In some cases, the persons belonging to the foregoing categories operate in complete autonomy as separate Data Controllers; in others, they operate as Data Processors specifically appointed by the Data Controller in compliance with article 28 of the GDPR.
A complete and updated list of the persons to whom your personal data may be communicated can be requested from the registered office of the Data Controller or by contacting its DPO.
Your personal data will not be transferred to third parties outside the European Union and will not be disseminated.

 

6. Data of minors

 

The Data Controller does not process the personal data of persons under the age of 16 for the purposes referred to in sections 3.1 and 3.2 above.
If the User says that he/she is less than 16 years old, the field relating to the giving of consent will be pre-completed with a negative response.

 

7. Your rights as a data subject

 

In relation to the processing described in this Privacy Notice, as a data subject you can, under the conditions specified by the GDPR, exercise the rights enshrined in articles 15 to 21 of the GDPR and, in particular, the following rights:

 

  • Right of access – article 15 of the GDPR: The right to obtain confirmation of whether personal data concerning you is being processed and, if it is, to obtain access to your personal data – including a copy thereof – and notification of the following information, inter alia:
    • Purposes of the processing
    • Categories of personal data processed
    • Recipients to whom the data has been or will be communicated
    • Data retention period or the criteria used
    • Rights of the data subject (rectification or erasure of personal data, restriction of processing and the right to object to processing
    • Right to complain
    • Right to receive information on the origin of personal data if it has not been collected from the data subject
    • The existence of an automated decision-making process, including profiling.
  • Right to rectification – article 16 of the GDPR: The right to obtain, without undue delay, the rectification of inaccurate personal data concerning you and/or the completion of incomplete personal data
  • Right to erasure (right to be forgotten) – article 17 of the GDPR: The right to obtain, without undue delay, the erasure of personal data concerning you, when:
    1. The data is no longer necessary in relation to the purposes for which it was collected or otherwise processed
    2. You have withdrawn your consent and there is no other legal basis for the processing
    3. You have successfully objected to the processing of personal data
    4. The data has been unlawfully processed
    5. The data must be erased to fulfil a legal obligation
    6. The personal data has been collected in relation to the offer of information society services referred to in article 8 (1) of the GDPR.
    The right to erasure does not apply where the processing is necessary for the fulfilment of a legal obligation or for the performance of a task carried out in the public interest or for the establishment, exercise or defence of rights in legal proceedings.
  • Right to restriction of processing – article 18 of the GDPR: Right to obtain restriction of processing, when:
    1. The data subject disputes the accuracy of the personal data
    2. Processing is unlawful and the data subject objects to erasure of the personal data and requests restriction of its use instead
    3. the controller no longer needs the personal data for the purposes of the processing, but the personal data is required by the data subject for the establishment, exercise or defence of rights in legal proceedings
    4. The data subject has objected to processing as indicated above, pending the verification whether the legitimate grounds of the controller override those of the data subject.
  • Right to data portability – article 20 of the GDPR: The right to receive, in a structured, commonly used, machine-readable format, the personal data concerning you which has been provided to the Data Controller, and the right to transmit it to another Data Controller without hindrance, providing that processing is based on consent and is carried out by automated means. Also, the right to arrange for your personal data to be transmitted directly from the Data Controller to another data controller if this is technically feasible.
  • Right to object – article 21 of the GDPR: The right to object, at any time, to the processing of personal data concerning you, based on to the legitimacy of the legitimate interest, including profiling, unless there are legitimate grounds for the Data Controller to continue processing that override the interests, rights and freedoms of the data subject; or for the establishment, exercise or defence of a right in legal proceedings.
  • Right to make a complaint to the Italian Data Protection Authority, Piazza di Montecitorio no. 121, 00186, Rome (RM).

 

The above-mentioned rights may be exercised against the Data Controller by writing to the contact addresses indicated in point 1. The Data Controller will take charge of your request and, without undue delay and, in any event, no later than one month after receipt of the request, notify you regarding the action taken in respect of your request.

 

Exercising your rights as a data subject shall be free of charge pursuant to article 12 of the GDPR. In the case of manifestly unfounded or excessive requests, however, in particular because of their repetitive character, the Data Controller may charge a reasonable fee, to reflect the administrative costs incurred in handling your request, or refuse to act on it.

 

Finally, we inform you that the Data Controller may request further information necessary to confirm the identity of the data subject.

Gentile Utente, La invitiamo a prestare attenzione alla seguente Informativa ("l'Informativa"), rilasciata ai sensi dell'articolo 13 del Regolamento (UE) 2016/679 relativo alla protezione delle persone fisiche con riguardo al trattamento dei dati personali, nonché alla libera circolazione di tali dati ("GDPR").
Il presente documento contiene la descrizione di tutti i trattamenti effettuati dal Titolare, come di seguito definito.
Precisiamo che l'Informativa riguarda esclusivamente la APP Vespa; si considera pertanto escluso ogni sito Web al quale Lei potrà essere reindirizzato dal Sito Web.
Inoltre, qualora Lei dovesse acquistare prodotti o fruire di servizi Piaggio non tramite la APP Vespa, ma attraverso canali ufficiali Piaggio, al momento dell'acquisto Le verrà rilasciata una specifica informativa ai sensi dell'art. 13 del GDPR relativa ai Suoi dati personali trattati in quell'occasione.

2. Quali dati personali trattiamo

 

2.1 Dati forniti volontariamente dall'utente

 

Il Titolare tratta i seguenti dati personali:
dati anagrafici: come ad es. nome, cognome, data di nascita, patente di guida, foto del profilo, indirizzo, nazionalità, numero di telefono, indirizzo e-mail e altri dati di contatto;
dati di utilizzo: i dati raccolti automaticamente dall'Applicazione incluso: l'identificazione del dispositivo sul quale è installata l'app che collega al veicolo VESPA, l'orario della richiesta ai server, il metodo utilizzato nel sottoporre la richiesta ai server, la dimensione del file ottenuto in risposta, il codice numerico indicante lo stato della risposta data dal server (buon fine, errore,ecc.), il paese di origine, una serie di dati tecnici relativi all'uso del veicolo VESPA associato all'App inclusi:

 

  • nome del veicolo
  • modello
  • cilindrata
  • anno di produzione
  • n. telaio
  • percorrenza totale
  • ultimo tagliando
  • immagine del veicolo
  • Velocità media del veicolo durante il viaggio
  • Consumo medio del veicolo durante il viaggio
  • Distanza percorsa durante il viaggio
  • Data di inizio e durata del viaggio

 

UTILIZZO DELLA POSIZIONE GPS

 

E’ possibile autorizzare l'app a registrare la posizione durante l’utilizzo attivo della app o mentre la stessa è aperta in background. Per utilizzare l'app, non è necessario accettare di registrare la propria posizione ma alcune funzionalità dell'app dipendono dalle informazioni sulla posizione relative al proprio dispositivo mobile ed al veicolo. Se si autorizza l'app a utilizzare la propria posizione, è possibile la navigazione tramite l'app (indicazioni di svolta, ricerca punti di interesse e visualizzazione della posizione sulle mappe di navigazione). Se si autorizza a registrare la posizione, tuoi viaggi effettuati saranno registrati anche nella sezione "attività". Tutti i dati sul percorso possono essere visualizzati ed eliminati dall'utente nell'app in qualsiasi momento. L'eliminazione del profilo del veicolo rimuove anche tutte le attività associate. Si noti, in questo contesto, che l'attivazione continua del GPS in background può ridurre significativamente la durata della batteria del dispositivo mobile. Se si accetta la registrazione delle informazioni sulla posizione, l'app memorizzerà i dati di posizione localmente sul dispositivo mobile, senza ulteriore accesso da parte del Titolare o di terze parti, a tempo indeterminato. Se si decide di non rilasciare le informazioni sulla posizione o la funzione “attività” non è attivata, l'app non le registrerà più i dati di viaggio.
Per usufruire di alcune funzionalità della app, in alcuni casi la posizione è acquisita dal sistema GPS del dispositivo mobile Apple o Android. In particolare, tramite il dispositivo su cui è installata l'app, è possibile attivare o disattivare in qualsiasi momento e a propria discrezione qualsiasi funzionalità relativa alla geolocalizzazione, alla registrazione dei propri percorsi, alla possibilità di condividere i percorsi con altri utenti della App, il servizio per localizzare le officine VESPA, la registrazione dei parametri di guida e gli avvisi sulla manutenzione e sullo stato del veicolo.
I dati relativi alla posizione geografica e ai viaggi vengono elaborati da PIAGGIO solo per attivare le funzionalità della app quando richieste. I gli altri dati di funzionamento del veicolo sono registrati sia sul dispositivo mobile che sui server PIAGGIO, in modo che l’utente possa accedervi e utilizzarli attraverso la piattaforma dell'app VESPA in caso di successiva sostituzione o perdita del dispositivo. E’ possibile eliminare in qualsiasi momento i dati registrati tramite l'App stessa o eliminare il account completo. Dopo 12 mesi dall'ultimo accesso all'App, i dati registrati dall'App sui server PIAGGIO verranno eliminati. Gli altri dati personali relativi all’interazione con PIAGGIO, anche attraverso l'App, saranno conservati da PIAGGIO nei limiti consentiti dalla legge e in conformità con la Politica di conservazione dei dati di PIAGGIO. Per ulteriori informazioni, si prega di contattare PIAGGIO o il responsabile della protezione dei dati.

 

3. Finalità per le quali sono trattati i Suoi dati personali e base giuridica del trattamento

 

I dati personali da Lei forniti sono trattati dal Titolare per le seguenti finalità.

 

3.1 Erogazione dei servizi

 

Il Titolare intende trattare i Suoi dati personali al fine di consentirle l'accesso ai servizi offerti dall'App.
Natura del consenso al trattamento dei dati: facoltativa.
Conseguenze del rifiuto a consentire il trattamento dei dati: il mancato conferimento del consenso comporterà l'impossibilità per il Titolare di soddisfare le Sue richieste ai sensi del precedente paragrafo.
Base giuridica del trattamento: articolo 6 (1) (b) GDPR. Pertanto non è necessario ottenere un Suo preventivo consenso al trattamento.
Periodo di conservazione dei dati personali: i Suoi dati personali raccolti per le finalità indicate saranno trattati per il tempo strettamente necessario per evadere la Sua richiesta e successivamente conservati per il tempo richiesto dalle norme applicabili dal momento dell'evasione della Sua richiesta.

 

3.2 Attività di marketing concernenti prodotti e servizi analoghi a quelli già richiesti dall'Utente

 

Il Titolare intende trattare i Suoi dati personali al fine di inviarle comunicazioni commerciali concernenti prodotti e servizi analoghi a quelli da Lei richiesti e offerti dal Titolare anche tramite i soggetti Responsabili, nominati all'uopo ai sensi dell'art. 28 del GDPR.
Finalità del trattamento: invio di materiale pubblicitario, promozione e vendita di prodotti, indagini e ricerche di mercato e/o comunicazioni commerciali.
Natura del consenso al trattamento dei dati: facoltativa.
Conseguenze del rifiuto a consentire il trattamento dei dati: il mancato conferimento del consenso comporterà l'impossibilità per il Titolare di inviarle comunicazioni promozionali e di marketing.
Base giuridica del trattamento: legittimo interesse.
Periodo di conservazione dei dati personali: i Suoi dati personali raccolti per le finalità indicate saranno trattati finché Lei non decide di opporsi al trattamento e/o di ottenere la cessazione dello stesso in qualunque momento.

 

3.3 Attività di marketing

 

Il Titolare intende trattare i Suoi dati personali al fine di inviarle comunicazioni commerciali concernenti tutti i prodotti e i servizi offerti dal Titolare medesimo anche tramite i soggetti Responsabili, all'uopo nominati ai sensi dell'art. 28 del GDPR.
Finalità del trattamento: invio di materiale pubblicitario, promozione e vendita di prodotti, indagini e ricerche di mercato e/o comunicazioni commerciali.
Natura del consenso al trattamento dei dati: facoltativa.
Conseguenze del rifiuto a consentire il trattamento dei dati: il mancato conferimento del consenso comporterà l'impossibilità per il Titolare di inviarle comunicazioni promozionali e di marketing.
Base giuridica del trattamento: consenso
Periodo di conservazione dei dati personali: i Suoi dati personali raccolti per le finalità indicate saranno trattati finché Lei non decide di opporsi al trattamento e/o di ottenere la cessazione dello stesso in qualunque momento.

 

4. Con quali modalità saranno trattati i Suoi dati personali

 

Il trattamento dei Suoi dati personali avverrà, nel rispetto delle disposizioni previste dal GDPR, mediante strumenti cartacei, informatici e telematici, con logiche strettamente correlate alle finalità indicate e, comunque, con modalità idonee a garantirne la sicurezza e la riservatezza in conformità alle disposizioni previste dall'articolo 32 del GDPR.

 

5. Soggetti ai quali potranno essere comunicati i Suoi dati personali e che potranno venirne a conoscenza

 

Per il perseguimento delle finalità descritte al precedente punto 3, i Suoi dati personali saranno conosciuti dai dipendenti, dal personale assimilato e dai collaboratori del Titolare, che opereranno in qualità di soggetti autorizzati al trattamento dei dati personali.
Inoltre, i Suoi dati personali saranno comunicati e trattati da soggetti terzi appartenenti alle seguenti categorie:

 

  1. soggetti di cui il Titolare si avvale per la gestione dell'App
  2. società che gestiscono il sistema informatico del Titolare
  3. società e consulenti che forniscono attività di consulenza legale e/o finanziaria
  4. autorità e organi di vigilanza e di controllo, e in generale soggetti pubblici o privati con funzioni di tipo pubblicistico
  5. soggetti di cui il Titolare a vario titolo si avvale per la fornitura del servizio richiesto
  6. altre società del Gruppo Piaggio, per finalità di marketing, vendita diretta, sondaggi di mercato, elaborazioni statistiche quali il monitoraggio del grado di soddisfazione dei clienti circa i servizi e i prodotti di Piaggio e/o di altre società del Gruppo Piaggio, nonché per la comunicazione a soggetti esterni (ad es. fornitori) qualora ciò sia necessario per consentirle di beneficiare dei nostri servizi.

 

Lei avrà in ogni momento il diritto di revocare il consenso eventualmente prestato. Ciò determinerà l'impossibilità per il Titolare di continuare a utilizzare i Suoi dati personali per la finalità in relazione alla quale Lei avrà negato il consenso.
I soggetti appartenenti alle categorie sopra riportate operano, in alcune ipotesi, in totale autonomia come distinti Titolari del trattamento, in altre, in qualità di Responsabili del trattamento nel rispetto dell'articolo 28 del GDPR.
L'elenco completo e aggiornato di tutti i soggetti a cui i Suoi dati personali possono essere comunicati può essere richiesto presso la sede legale del Titolare o contattando il DPO.
I Suoi dati personali non saranno trasferiti a soggetti terzi all'esterno dell'Unione europea e non sono oggetto di diffusione.

 

6. Dati di minori

 

Il Titolare non tratta dati personali di soggetti minori di 16 anni per le finalità di cui ai precedenti punti 3.1 e 3.2.
Qualora l'Utente abbia dichiarato di essere minore di anni 16, il campo relativo alla raccolta del consenso verrà pre-compilato in maniera negativa.

 

7. Quali diritti ha Lei in qualità di interessato

 

In relazione ai trattamenti descritti nella presente Informativa, in qualità di interessato Lei potrà, alle condizioni previste dal GDPR, esercitare i diritti sanciti dagli articoli da 15 a 21 del GDPR e, in particolare, i seguenti diritti:

 

  • Diritto di accesso – articolo 15 GDPR: diritto di ottenere la conferma che sia o meno in corso un trattamento di dati personali che La riguardano e, in tal caso, ottenere l'accesso ai Suoi dati personali, compresa una copia degli stessi, e la comunicazione, tra le altre, delle seguenti informazioni:
    • finalità del trattamento
    • categorie di dati personali trattati
    • destinatati cui sono stati o saranno comunicati i dati
    • periodo di conservazione dei dati o criteri utilizzati
    • diritti dell'interessato (rettifica o cancellazione dei dati personali, limitazione del trattamento e diritto di opposizione al trattamento)
    • diritto di reclamo
    • diritto di ricevere informazioni sull'origine dei dati personali se non sono stati raccolti presso l'interessato
    • esistenza di un processo decisionale automatizzato, compresa la profilazione.
  • Diritto di rettifica – articolo 16 GDPR: diritto di ottenere, senza ingiustificato ritardo, la rettifica dei dati personali inesatti che La riguardano e/o l'integrazione dei dati personali incompleti

Utilisation de votre position

 

Vous pouvez autoriser l'application à enregistrer votre position tant que vous utilisez activement l'application ou qu'elle est ouverte en arrière-plan. Pour utiliser l'application, vous n'êtes pas obligé d'accepter d'enregistrer votre position, mais certaines fonctionnalités de l'application dépendent des informations de localisation de votre appareil mobile et de vos véhicules enregistrés. Si vous autorisez l'application à utiliser votre position, la navigation via l'application est possible (tour par tour, recherche de POI et affichage de position sur les cartes de navigation). Si vous nous autorisez à enregistrer votre position, vos trajets seront également enregistrés dans la section "activités". 4. Methoden zur Verarbeitung Ihrer personenbezogenen Daten

6. Bergarbeiterdaten

 

Der Auftragsverarbeiter verarbeitet die personenbezogenen Daten von Personen unter 16 Jahren nicht für Zwecke in den Abschnitten 3.1 und 3.2.
